Terms of Service

1. Acceptance of Terms 

By accessing or using the “Site” (https://www.firelight-logic.com) and any associated digital content or virtual meetings (the “Services”), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws. If you do not agree, please do not use our Site or Services. 

Third-Party Infrastructure: Our Site is hosted on Amazon Web Services (“AWS”). By using our Services, you acknowledge that your use is also subject to the AWS Acceptable Use Policy (available at aws.amazon.com/aup). You agree not to engage in any activity that would cause Firelight Logic LLC to violate its agreements with AWS or any other third-party infrastructure providers. If you do not agree to these terms, you must immediately cease all use of the Site. 

2. User Conduct & Security 

You are solely responsible for your conduct while using the Site. To maintain the security and integrity of our AWS-hosted infrastructure, you agree not to: 

  • Probe, scan, or test the vulnerability of our Site, servers, or networks, or attempt to breach any security or authentication measures. 
  • Engage in any activity that imposes an unreasonable load on our infrastructure, including but not limited to Denial of Service (DoS) attacks, “flooding,” or “spamming.” 
  • Upload, post, or transmit any software or files that contain viruses, Trojan horses, worms, time bombs, or any other computer programming routines that are intended to damage, detrimentally interfere with, or surreptitiously intercept any system, data, or personal information. 
  • Attempt to gain unauthorized access to any portion of the Site or AWS management consoles associated with the Service. 
  • Use any robot, spider, or other automated means to access the Site for any purpose without our express written permission. 
  • Engage in any “Prohibited Content” or “Prohibited Activities” as defined by the AWS Acceptable Use Policy, including hosting or transmitting illegal content or infringing on the intellectual property rights of others. 

Right to Terminate: We reserve the right to immediately suspend or terminate your access to the Site, without notice, if we—or our hosting providers—determine in our sole discretion that your actions threaten the security or stability of our Services. 

3. Service Availability, Maintenance, and Force Majeure 

3.1. General Availability: While we strive to provide a seamless user experience, Firelight Logic LLC does not guarantee that the Site or Services will be functional, uninterrupted, or error-free at all times. Our Services rely on third-party infrastructure providers, including Amazon Web Services (AWS). You acknowledge that technical outages, server failures, or “cloud” interruptions are beyond our direct control. 

3.2. Scheduled and Emergency Maintenance: We reserve the right to temporarily suspend access to the Site or specific Services for: 

  • Scheduled Maintenance: Routine updates to improve performance or security. We will make reasonable efforts to notify you in advance via site announcement. 
  • Emergency Maintenance: Immediate actions required to address security threats, critical bugs, or infrastructure failures. 

3.3. Force Majeure: Firelight Logic LLC shall not be held liable for any delay or failure to perform its obligations (including the hosting of virtual meetings) resulting from causes outside its reasonable control. This includes, but is not limited to: acts of God, strikes, power failures, natural disasters, “upstream” internet service provider failures, AWS regional outages, or government mandates. 

3.4. Limitation of Liability for Downtime: To the maximum extent permitted by law, you agree that Firelight Logic LLC is not liable for any frustration caused by the temporary unavailability of the Site. If a meeting scheduled through Microsoft Bookings is interrupted by a service outage, our sole obligation is to reschedule that session at a mutually convenient time. 

4. Technical Requirements for Users 

4.1. User Responsibility: To participate in virtual meeting sessions, you are responsible for obtaining and maintaining all necessary hardware, software, and high-speed internet connectivity. Firelight Logic LLC is not responsible for your inability to access the Services due to limitations in your equipment or internet service. 

4.2. Recommended Specifications: For an optimal experience, we recommend: 

  • A stable broadband internet connection (minimum 5 Mbps upload/download for live video meetings). 
  • A modern web browser (e.g., Chrome, Firefox, Safari, or Edge) updated to the latest version. 
  • Functional audio and video hardware (microphone, speakers, and camera) for live video meetings. 

4.3. Third-Party Software: Some Services may require the use of third-party platforms (e.g., Microsoft Bookings). You agree to comply with the terms and conditions of these third-party providers. 

5. Cancellations 

5.1. Virtual Meeting Sessions: 

  • Cancellation/Rescheduling by Client: We request 24-hours’ notice for any meeting rescheduling or cancellation. 
  • Cancellation by Firelight Logic LLC: In the rare event that we must cancel a session (e.g., due to illness or emergency), we will provide as much notice as possible and offer you a priority reschedule. 

6. Intellectual Property 

All content on this Site, including course materials, videos, and logos, is the property of Firelight Logic LLC. You are granted a limited, non-transferable license to use these materials for personal use only. You may not resell, redistribute, or record sessions without written permission. 

7. Professional Disclaimer 

  • Not Professional Advice: The information provided on this Site and during meeting sessions is for educational and informational purposes only. It is not a substitute for any legal, financial, or medical advice. 
  • No Guarantees: While we always strive to help you succeed, Firelight Logic LLC does not guarantee specific results or earnings. 

8. Privacy and Data Security 

8.1. Privacy Policy: Your use of the Site and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and share your personal information. 

8.2. Data Security: We implement industry-standard security measures provided by our hosting partner, Amazon Web Services (AWS), to protect your data. However, you acknowledge that no method of transmission over the internet or electronic storage is 100% secure. 

8.3. Third-Party Processing: You acknowledge that we use third-party service providers (such as AWS for hosting) to facilitate our Services. These providers have their own security protocols, and Firelight Logic LLC is not responsible for any security breaches occurring on their systems, provided we have exercised reasonable care in selecting such providers. 

9. Limitation of Liability and Governing Law 

To the fullest extent permitted by law, Firelight Logic LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or participation in our meeting sessions. These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws provisions.

10. Changes to These Terms 

We will update these Terms of Service as needed. We will notify you of any changes by posting the new terms on this page and updating the “Last Updated” date.
